Information about Successful Writer Marketplace

The following terms of service (these "Terms of Service"), describe your use of the Successful Writer Marketplace website (the "Site") by Successful Writer, LLC (P.O. Box 29, Glennallen AK  99588) referred hereto as "Successful Writer Marketplace" "we" or "us." The terms “you” or “user” means you as an user of the Site.

 

Please read the Terms of Service before you use the Site. By using the Site, opening an account, or by agree to the Terms of Service, you accept and agree to be bound and abide by these Terms of Service.

 

You also verify that content or use thereof in the Site does not violate any applicable local, state, federal and international laws

 

Site users must be 18 years of age or older and of legal age to form a binding contract. If you are over 13 years of age but under 18, you are only permitted to use the Site if you have permission to use an account that is owned and funded by a parent or legal guardian. Children under 13 are not permitted to use the Site or services offered by Successful Writer Marketplace. By using the Site, you agree that you meet all of these requirements. If you do not meet all of these requirements, you must not access or use the Site.

Deals are the services being sold on the Site.

Orders are the formal agreements between a Buyer and Seller after a purchase is made from the Seller’s Deal Page.

Sellers are users who offer and perform services by posting Deals on the Successful Writer Marketplace.

You must be a registered user to sell your services through the Successful Writer Marketplace. You are the sole person responsible for any activity on your account and for maintaining the confidentiality and security of your password and personal information. We are not liable for any acts or omissions by Users in connection with their account.

Sellers are obligated and required to fulfill their Orders, and may not cancel Orders without cause. Canceling Orders will affect Sellers’ reputation and status and repeated abuse of the system will result in termination of account without notification.

Users may not offer or accept payments using any method other than placing an Order through the Site.

When purchasing a Deal through the Successful Writer Marketplace, Buyers are granted all rights for the delivered work.

Sellers create Deals on Successful Writer Marketplace to allow Buyers to purchase their services.

Successful Writer Marketplace reserves the right to approve or remove Deals at our discretion and is not obligated to approve or invite Sellers.

Sellers must have a PayPal account to post Deals on the Site.

When a Buyer is interested in an offer, they will authorize a payment via Paypal. Sellers are not obligated to accept an offer.

The Seller will have three (3) days to review and accept the offer. At the time the Seller accepts the offer, the Buyer will be charged and the Seller will be paid via Paypal.

At the time of payment, the Seller’s Paypal account will automatically send Successful Writer Marketplace our commission.

Successful Writer Marketplace charges a 20% commission on a Seller’s Deal price. Paypal will also take out fees from the Seller. You can see PayPal’s merchant fees at https://www.paypal.com/us/webapps/mpp/merchant-fees

Successful Writer Marketplace does not charge the Buyer any transaction fees.

Buyers and Sellers should communicate via the Site’s messaging system to share any information relevant to the completion of each Deal.

When the Deal is complete, the Buyer should click the Mark Completed box on the order page, which can be found in the Site’s inbox when you’re logged in.

When a Deal is complete, the Buyer is granted all intellectual property rights for the work, and the Seller waives any and all moral rights therein. 

Successful Writer Marketplace does not make any guarantees or monitor finalized Deals for quality, appropriateness, violations of copyright, trademarks, other rights or violations. The Seller creating such content shall be solely responsible for it.  

In the event of a dispute, we encourage Buyers and Sellers to communicate directly with each other via the Site’s messaging and Inbox system to reach a resolution.

If no such resolution can be reached, the Buyer may dispute an Order by clicking the “Dispute” button on their Order page, which is accessible through the inbox button.

Successful Writer Marketplace admins and the Seller will be notified of the dispute. Successful Writer Marketplace will work with both parties to attempt to reach a resolution.

Any information necessary to complete a Deal should be exchanged in the Site’s messaging system.

Successful Writer Marketplace does not provide any warranty or guarantee regarding the quality of service offered to Buyers.

Successful Writer Marketplace does not provide protection for users who interact outside of the Successful Writer Marketplace platform.

All information and file exchanges must be performed exclusively on Successful Writer Marketplace's platform.

Rude, abusive, improper language, or threatening messages will not be tolerated. Abusers of our terms of service may be removed without notice.

Users may not submit proposals or solicit parties introduced through Successful Writer Marketplace to contract, engage with, arrange payment, or complete payment outside of Successful Writer Marketplace.

Sellers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.

Sellers warrant that content in their Deals is original work that does not infringe any third party rights. If a Seller uses stock images or other media, Sellers represent and warrant that they hold a valid license to use that footage or other media. 

Plagiarism of any type is not tolerated on this Site. By offering a service, the Seller undertakes that they have sufficient permissions, rights and/or licenses to provide the service that is offered on Successful Writer Marketplace. 

Users may use the feedback feature to leave public reviews. Sellers are not allowed to contact Buyers regarding reviews and are not allowed to request or demand a certain rating or provide wording for any review. 

Sellers agree to hold any personal or private information about Buyers in strict confidence and to use that information solely for the purpose of completing their Deals.

Deals are not to be used for examples or portfolio work without permission from Buyer.

Adult Services & Pornography - Successful Writer Marketplace does not permit the purchase or selling of adult oriented or pornographic materials and services.

 

Harassment - All interactions on Successful Writer Marketplace must be constructive and professional and free of inappropriate behavior or threatening or abusive language.

 

Phishing and Spam - You may not collect or phish for personal information. You may not contact other users with offers, questions, suggestions or anything which is not directly related to their Deals or orders.

 

Hacking and Bots - Users may not use bots, hacks, mods or any other unauthorized third-party software designed to modify the Site and may not introduce or attempt to introduce any type of virus or trojan horse to Site

 

Communicating outside the Marketplace - Discussions related to orders should be communicated via the Successful Writer Marketplace’s messaging system. Users who communicate off of Successful Writer Marketplace will not be protected by our Terms of Service. Successful Writer Marketplace can monitor private messages between users to identify breaches to these Terms of Service.

 

Plagiarism and Copyright infringement - Sellers must create original work that doesn’t infringe on the copyright or intellectual property of others. Similarly, the Successful Writer Marketplace site, including its layout, design, images, content and other materials available thereon, is exclusively owned by Successful Writer Marketplace and protected by copyright and other intellectual property laws. 

 

Privacy & Identity - You may not publish or share other users’ personal information. Any information a Seller receives information from a Buyer shall not be used for any other purpose than for the completion of the work. Successful Writer Marketplace is not responsible for the security of any passwords or other secure information shared between Buyers and Sellers. 

 

Fraud / Unlawful Use - You may not use Successful Writer Marketplace for any unlawful purposes or to conduct illegal activities.

 

Multiple Accounts - A user may only have one (1) Successful Writer Marketplace account. Accounts cannot be transferred or sold.

Successful Writer Marketplace reserves the right to remove any users from the Site and terminate their right of use of the service without any specific reason and without being liable for compensation.

Successful Writer Marketplace may change Terms of Service as needed and warranted. In this event, Successful Writer Marketplace will make a new copy of the terms of service available on this page with the date of the newest updated Terms of Service. 

You understand and agree that if you use Successful Writer Marketplace after the date on which the Terms of Service have changed, Successful Writer Marketplace will treat your use as acceptance of any and all updated Terms of Service.
